Terms and Conditions

These Terms are an agreement between you and CourseGeni by Takxila ("CourseGeni", "we", "us") for using CourseGeni by TAKXILA at www.coursegeni.com and its learner portals (the "Service"). By creating an account or using the Service, you accept these Terms, our Privacy Policy, Refund Policy, and Subscription and Purchase Terms. If you use the Service for an organisation, you confirm you are authorised to accept these Terms for it.

1. The Service

CourseGeni lets you create online courses from documents or prompts using AI, edit them, download them as SCORM or PDF, and publish them on a learner portal. Features and limits depend on your plan.

2. Accounts

• You must be at least 18 years old to create a customer account.
• Give accurate details and keep them up to date.
• Keep your login secure. You are responsible for activity under your account and your team members' accounts.
• Only one Free account is allowed per person, email address or organisation. We may close duplicate or fake accounts.
• The workspace Owner controls the workspace, its users and its billing.

3. Your content

• You own your content: the documents you upload and the courses generated from them.
• You give us a limited permission to store, process, display and transmit your content only to provide the Service to you and your learners.
• You confirm you have the rights to everything you upload, and that it does not break any law or anyone else's copyright, trademark, privacy or other rights.
• We do not use your content to train AI models.

4. AI-generated content

• AI can produce errors, outdated information or content similar to other sources. You are responsible for reviewing courses before you publish or share them.
• Check safety, legal, medical, financial and compliance content carefully. CourseGeni flags AI-added content to help you, but final responsibility is yours.
• We do not guarantee that AI output is accurate, complete or fit for any particular purpose.

5. Learners and your portal

If you publish courses on your portal, you decide who can access them and you are responsible for your learners' use. You must have a lawful basis to add learners' personal data, including parental consent for learners under 18. We process learner data on your behalf, as described in our Privacy Policy.

6. Acceptable use

You must not:

• Upload illegal, obscene, defamatory, hateful or infringing content, or content that promotes violence.
• Upload malware or harmful files, or SCORM packages built to attack users or systems.
• Try to access other customers' data, break security, or overload the Service.
• Resell, copy or reverse-engineer the Service, or use it to build a competing product.
• Create multiple Free accounts or otherwise get around plan limits.
• Use automated tools to extract data or generate content beyond normal use.

We may remove content or suspend accounts that break these rules, with notice where reasonable.

7. Fair use of AI

AI features are limited by your plan's generation units and AI edit credits. We may limit unusual or excessive use that harms the Service or other customers, and will contact you first where possible.

8. Our intellectual property

The CourseGeni software, design, templates, themes and the TAKXILA name and logo belong to us. Using the Service gives you no ownership of them. You may use our course themes and templates inside courses you create with CourseGeni, including in downloaded SCORM and PDF files.

9. Free plan watermark

Courses and certificates on the Free plan show "Created with CourseGeni by TAKXILA". You must not remove or hide it. Paid plans have no watermark.

10. Availability and changes

We aim to keep the Service available, but do not guarantee it will be uninterrupted or error-free. We may carry out maintenance and add, change or remove features. If we remove a major paid feature during your plan term, we will offer a fair alternative or a pro-rata refund.

11. Suspension and termination

• You can stop using the Service anytime. Refunds follow our Refund Policy.
• We may suspend or close your account for serious or repeated breach of these Terms, non-payment, or if required by law.
• After closure, you can export your data for 30 days; after that it is deleted, except what the law requires us to keep.

12. Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties not expressly stated in these Terms.

13. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential losses, such as lost profits, data or business. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

14. Indemnity

You agree to compensate us for claims arising from your content, your learners' use of your portal, or your breach of these Terms or the law.

15. Governing law and disputes

These Terms are governed by the laws of India. We will first try to resolve any dispute through discussion. If that fails within 30 days, the courts at Pune, Maharashtra, India have exclusive jurisdiction.

16. Changes to these Terms

We may update these Terms. We will post the new version here and, for important changes, email account Owners at least 15 days before they apply. Continuing to use the Service after that means you accept the new Terms.
